2. ACCEPTANCE OF TERMS
By accessing and using the website www.probitas.biz (the "Site"), the user accepts these Terms and Conditions in full. If you do not agree with any part of these terms, you must refrain from using the Site.
3. DEFINITIONS
"Customer", "You" and "Your" refer to the person accessing the Site. "Company", "We" and "Our" refer to PROBITAS — Comércio de Computadores e Serviços, Lda.
4. USE OF THE SITE
The Site is provided for legitimate personal and/or commercial use. The following is expressly prohibited:
- Using the Site for unlawful purposes or contrary to good faith;
- Attempting unauthorised access to restricted areas, servers or databases;
- Introducing malware, viruses or malicious code;
- Automated content collection (scraping) without written authorisation.
5. INTELLECTUAL PROPERTY
Unless otherwise indicated, PROBITAS and/or its licensors hold all intellectual property rights in the Site's content (text, images, logos, trademarks, software).
Users may view and print pages of www.probitas.biz exclusively for personal use. The following is expressly prohibited:
- Republishing content from probitas.biz on other media;
- Selling, renting or sublicensing Site material;
- Reproducing, duplicating or copying content for commercial purposes;
- Redistributing content without prior written authorisation.
6. PRODUCTS, PRICES AND ORDERS
Prices are shown in Euros (EUR) and include VAT at the applicable legal rate. PROBITAS reserves the right to change prices, specifications and availability without prior notice. In the event of an obvious pricing error, the order may be cancelled with full refund to the customer.
Order confirmation is only legally binding upon receipt of the confirmation email from PROBITAS.
7. STATUTORY WARRANTY OF CONFORMITY
Goods sold are covered by the statutory warranty of 3 years for consumers (natural persons), in accordance with Portuguese Decree-Law No. 84/2021. For business customers, the statutory warranty is 1 year (Portuguese Civil Code).
8. RETURNS AND RIGHT OF WITHDRAWAL
The consumer has a period of 14 days to exercise the right of withdrawal, without giving any reason, in accordance with Portuguese Decree-Law No. 24/2014. See details in our Returns and Refunds Policy.
9. DISPUTE RESOLUTION
Electronic Complaints Book — in accordance with Portuguese Decree-Law No. 74/2017, you may file a complaint at www.livroreclamacoes.pt.
Alternative Dispute Resolution (ADR) — in accordance with Portuguese Law No. 144/2015, in the event of a dispute the consumer may refer the matter to the competent ADR entity:

10. LIMITATION OF LIABILITY
To the maximum extent permitted by law, PROBITAS shall not be liable for indirect damages, loss of profits or loss of data resulting from the use of the Site or from products purchased, except in cases of wilful misconduct or gross negligence. Nothing in this clause limits statutory liability for death or personal injury caused by negligence, fraud, or other liabilities that cannot be excluded under applicable law.
11. CHANGES
PROBITAS reserves the right to modify these terms at any time. The version in force is always the one published on this page.
12. GOVERNING LAW AND JURISDICTION
These Terms are governed by Portuguese law. For the resolution of any dispute arising from the use of the Site or from the commercial relationship, the consumer's forum (place of habitual residence) shall be competent where applicable, or, alternatively, the District Court of Lisbon West — Cascais.
