This Privacy Policy describes how PROBITAS — Comércio de Computadores e Serviços, Lda. ("we", "PROBITAS") collects, uses, shares, and protects your personal information when you visit or make purchases on www.probitas.biz (the "Site"), in accordance with Regulation (EU) 2016/679 ("GDPR") and Portuguese Law No. 58/2019 of 8 August.

2. PERSONAL INFORMATION WE COLLECT

Device Information — collected automatically while you browse the Site: IP address, browser type and version, operating system, time zone, pages visited, search terms that led to the Site, cookies (see section 7).

Order Information — when you make or attempt to make a purchase: name, billing address, shipping address, tax ID (optional), payment details, email, phone number.

Payment data is processed directly by payment providers (Stripe, PayPal, Multibanco/MB Way via IfThenPay) and is not stored on our servers.

3. LEGAL BASIS AND PURPOSES OF PROCESSING

• Performance of contract (Art. 6(1)(b) GDPR): order processing and shipping, invoicing, returns and warranty management.
• Legal obligation (Art. 6(1)(c) GDPR): invoice retention (10 years — Portuguese Commercial Code / CIVA), tax compliance.
• Legitimate interest (Art. 6(1)(f) GDPR): fraud prevention, Site security, service improvement.
• Consent (Art. 6(1)(a) GDPR): marketing communications, non-essential cookies. Consent may be withdrawn at any time.

4. SHARING WITH THIRD PARTIES (PROCESSORS)

• Jumpseller — e-commerce platform hosting
• Carriers — CTT, DPD, MRW (order delivery)
• Payment processors — Stripe, PayPal, IfThenPay (Multibanco/MB Way)
• Google Analytics / Google Ads — traffic analysis and measurement (with consent only)
• Meta (Facebook) Pixel — remarketing (with consent only)
• Authorities — when legally required (subpoenas, warrants, tax obligations)

5. INTERNATIONAL TRANSFERS

Some of our processors (Google, Meta, Stripe) may store or process data in the USA. These transfers are carried out under the Standard Contractual Clauses approved by Commission Implementing Decision (EU) 2021/914 or under the EU-US Data Privacy Framework (Adequacy Decision of 10/07/2023), as applicable.

6. DATA RETENTION

• Order data: 10 years (tax obligation — Art. 123 of the Portuguese CIVA)
• Customer account data: while the account is active + 5 years
• Marketing data: until withdrawal of consent
• Server logs: 12 months

7. COOKIES

• Functional: remembering user preferences (e.g., theme).

11. MINORS

The Site is intended for individuals aged 16 or over. We do not knowingly collect data from minors under 16 without the consent of those with parental responsibility (Art. 8 GDPR). If we become aware that we have collected data from a minor without the required consent, we will delete that information immediately.

We adopt appropriate technical and organisational measures to protect your personal data against unauthorised access, alteration, disclosure or destruction (TLS encryption, access controls, regular backups).
